Class Action Activism, Mosquitoes & Politicians that Bite & Tropical Dust – July 11th, 2025
Takeaway #1: That didn’t take long
It was only a matter of exactly when, not if, a federal district court judge would rule once again against President Trump’s executive order putting an end to “birthright citizenship” for children born in the United States, if at least one parent isn’t a legal citizen. In a surprise to no one, including the Justices at the Supreme Court who opened the door for this new legal battle over birthright citizenship to ensue, the legal battle is back on. As a quick recap you may recall it was just two weeks ago the United States Supreme Court ruled that it was unconstitutional for federal district judges to issue universal injunctions – something they had unconstitutionally done 64 times during Trump’s first term as they sought to slow down his agenda, and something they had already done 40 times in the early months of Trump’s second term prior to the SCOTUS ruling. But in that ruling, which significantly limited the judicial authority that could be exerted by district court judges, they chose not to rule on the birthright citizenship issue itself – sending that back to lower courts. As I predicted two weeks ago today... What we’ll likely see attempted going forward is an effort to obtain class-action status for lawsuits and left-wing states pursuing these cases to try to gain as much jurisdiction for rulings as possible. And yesterday that’s exactly what we saw as New Hampshire district court Judge Joseph LaPlante ruled against the president’s birthright citizenship order and further granted class-action status to not only 13 pregnant illegal immigrants represented by the ACLU – who were the plaintiffs in the case, but also to any pregnant illegal immigrants anywhere in the country. In the words of the ACLU following the ruling: Today’s decision is a victory for our plaintiffs, and millions of families across this country. Right, because that was certainly the intent of the Supreme Court that had just ruled it to be unconstitutional for a district court judge to issue universal injunctions. Now there can just be endless universal class action lawsuits decided by district court judges. This ruling temporarily stops the Trump administration from its planned end to birthright citizenship for children of illegal immigrants, which was set to kick in July 27th, the earliest available date based on the timing of the Supreme Court’s ruling. What it also does is set the stage for the legal appeals process on both the birthright citizenship issue itself, but potentially also for the immediate and blatant abuse of a class action lawsuit to achieve the identical effect of a nationwide injunction by a district court judge. Something that’s likely once again to be decided by the Supreme Court in the end.
Takeaway #2: This just in. There are mosquitoes in the Everglades
Oh...in other news thousands of native Americans have lived in the Everglades for thousands of years. So tomorrow the Florida Division of Emergency Management, in conjunction with the Department of Homeland Security, is conducting a tour of Alligator Alcatraz for “concerned” legislators. The irony is that for the Democrats, who are attempting to politically exploit the country’s newest and largest detention and deportation facility, they evidently didn’t realize how this looks to the rest of us. First, if you’re represented by Lois Frankel, Maxwell Frost, Jared Moskowitz, Debbie Wasserman Schultz or Darren Soto – you have my sympathy (I speak as a member of this class of underserved constituents). Second, what you’re set to see tomorrow is that these congressional representatives are going to be more attentive to criminal illegal immigrants than they are to you or any of their constituents. When was the last time any of these peeps spent any time addressing your concerns in your neighborhood? Yet tomorrow they’re set to inspect an illegal immigrant detention and deportation facility that isn’t even in any of their neighborhoods. None of these Dems represent the Alligator Alcatraz district! What’s more is that in a desperate attempt to take up for criminal illegal immigrants, your state and local GSS news has taken to hyping mosquitoes in the Everglades! Related headlines this week have included: “Mosquitoes become a concern at Alligator Alcatraz”, Harsh conditions at ‘Alligator Alcatraz’: heat, rain, mosquitoes everywhere. ‘Mosquitoes size of elephants’: Detainees complian about ‘Alligator Alcatraz’ conditions. And there’s my favorite: Eskamani raises concerns about disease-carrying mosquitoes at ‘Alligator Alcatraz’...now that’s my favorite because ironically Eskamani and company didn’t have any concerns about disease-carrying illegal immigrants pouring across Biden’s open border during COVID... And here’s the kicker to all of this for these scam artist politicians who won’t be in their districts with their constituents but instead will be trying to score political points among a TDS riddled base while hanging out with criminal illegal immigrants...and for those covering them in the GSS news media. This just in, yes there are mosquitoes in the Everglades. Did you know that there are actual legal residents of the Everglades too? There are currently 1,240 native Americans who live on reservations in the Everglades with another 396 citizens who live in Everglades City. And one more thing...the natives have been there for thousands of years...and the mosquitoes too. And then there’s the minor detail that approximately a million people per year visit the Everglades recreationally. So yeah – this is how little these representatives and their allies in the GSS news – think of you. They expect you to be as dumb as the things that they say and do.
Takeaway #3: The dust will do
Heading into this weekend there’s of course heat in our forecast, the potential for thunderstorms too with a mix of another Saharan dust plume that’s currently working its way over you. Related, with the ultimate hurricane repellant still active across the Atlantic, Colorado State University has become the first forecaster to revise downward their projections for this year’s hurricane season. Citing hostile conditions including high levels of Caribbean wind shear, they’re now predicting one less named storm, hurricane and major hurricane. The dust and the wind shear will do.
